Certified Farmers' Market
In order to hold a Certified Farmers' Market within Sutter County, you must complete and
submit an
Application/Certificate for Certified Farmers' Market.
The annual fee for a
Certified Farmers' Market Certificate is $60.00. Fee payment must be included with
the application to initiate the certification process. A certificate is effective for
twelve (12) months from the date of issuance.
To qualify as an operator of a Certified Farmers' Market (CFM), you must be one of the following:
- Certified Producer
- Nonprofit Organization
- Local Government Agency
In addition to the completed application and fee payment, other documents are required to be
submitted to confirm your eligibility for participation in the Direct Marketing program. The
required documentation is listed below, based upon the type of organization the applicant is
applying under. Your application cannot be processed without submittal of the required
documentation.
If applying as a Certified Producer:- Copy of your valid Certified Producer Certificate;
- Copy of Certified Farmers' Market Rules, with current date of publication;
- Detailed map of market location, cross street, and CFM boundaries;
- A copy of any agreement, lease, etc. for right to hold CFM at designated location; and
- Copy of sample Load Sheet (form used to record daily sales by participants).
If applying as a Nonprofit Organization:- Copy of California Franchise Tax Board nonprofit status documentation;
- Letter authorizing market manager to act on behalf of nonprofit organization;
- Copy of Certified Farmers' Market Rules, with current date of publication;
- Detailed map of market location, cross street, and CFM boundaries;
- A copy of any agreement, lease, etc. for right to hold CFM at designated location; and
- Copy of sample Load Sheet (form used to record daily sales by participants).
If applying as a Local Government Agency:- Copy of Certified Farmers' Market Rules, with current date of publication;
- Letter authorizing market manager to act on behalf of government agency;
- Detailed map of market location, cross street, and CFM boundaries;
- A copy of any agreement, lease, etc. for right to hold CFM at designated location; and
- Copy of sample Load Sheet (form used to record daily sales by participants).
All agricultural products, when sold or offered for sale at a certified farmers' market,
shall also comply with all applicable requirements of:
- California Food and Agricultural Code
- California Code of Regulations
- California Retail Food Code
Note Regarding Food Services: Please note that all special events (including
street fairs, festivals, and some Certified Farmers' Markets) that involve food
service/sales to the public will require a separate permit from the Sutter County
Environmental Health, Division of Community Services, located at 1130 Civic
Center Blvd., Yuba City, CA 95993, telephone number (530) 822-7400.
Farmers' Market inspections will be conducted at least quarterly by our office without prior
announcement. ALL violations will be documented via written notice(s) of violation. Copies
of said notices, if written, will be provided to the CFM manager. In addition, copies of
load sheets will be required at time of inspection and must be provided to the inspector
within forty-eight (48) hours, if not available at time of inspection.

set forth in the California Food and Agricultural Code and the California Code of Regulations
detailing the requirements for managers and producers involved in the Direct Marketing/Certified
Farmers' Market program in California can be found below.
The Direct Marketing Program guidelines
for administrative civil penalties are also included in the above regulations. The guidelines are
intended to gain compliance while providing uniform enforcement action. The Direct Marketing
Program promotes fair competition among participants and ensures consumer confidence in the
quality and integrity of the CFM's. Please be advised that violations of Chapter 10.5 of the
California Food and Agricultural Code and/or Title 3, Article 6.5 of the California Code of
Regulations may result in civil administrative penalties pursuant to Section 47025 and the
attached guidelines.
Market managers are encouraged to post or distribute copies of the guidelines to all market participants.
